Tubbly boxes/lootbox - terms and conditions

1. General provisions

1. These Terms and Conditions (hereinafter: “Terms and Conditions”) set out the rules of the promotion “Tubbly Box/Lootbox” (hereinafter: “Promotion”) organized by TAM LABS LIMITED LIABILITY COMPANY (hereinafter: “we” or “Tubbly”).
2. Our full details:

3. The promotion runs from February 1, 2025 from 12:00 until you cancel it only in our online store and the Tubbly mobile application (hereinafter: “Store” or “Application”).
4. Information about the end of the Promotion will be posted on the website www.tubbly.io.
5. The promotion is valid in Poland.
6. The promotion is not a game of chance or a lottery within the meaning of the Gambling Act.
7. Promotion is not in conjunction with other promotions and contests hosted by Tubbly, unless we clearly indicate otherwise.
8. The Participant (hereinafter referred to as “You” or “User”) may redeem the Promotion multiple times, subject to the terms and conditions set forth in these Terms and Conditions.
9. The number of products included in the Promotion is limited.
10. In exceptional circumstances (e.g. system security breaches, unauthorized interference with the application, mass abuse) Tubbly reserves the right to suspend or terminate the Promotion immediately. In this case, Tubbly will inform Participants of the situation through the website or App.
11. If the Promotion is terminated for reasons beyond the control of the Participants, Tubbly will make every effort to minimize the negative impact on Participants (e.g., allow them to choose another form of reward or refund tokens/gems).

2. Who can participate in the Promotion

1. The Promotion can be used by any person who:
   
   1. has read and accepted these Terms and Conditions,
   2. she is of legal age,
   3. has full legal capacity,
   4. has a place of residence in Poland,
   5. if he acts as an entrepreneur — he is based in Poland,
   6. has an account in the Tubbly app,
   7. collect a minimum of 2 spots with tokens in Tubbly.
2. Tubbly reserves the right to verify the identity of the Participant at any stage of the Promotion, in particular when there is a reasonable suspicion that the Participant is providing false or incomplete data.
3. In order to verify the identity, Tubbly may require the Participant to present an identity document (with concealed sensitive data, such as the document number) or additional contact information.
4. In the event that it is not possible to verify the identity or refuse to provide the requested information, Tubbly has the right to exclude the Participant from the Promotion or refuse to issue the prize.

3. What is the Promotion

1. As part of the Promotion, the User has the opportunity to purchase selected products (hereinafter: “Products”) for free or at reduced prices.
2. To take advantage of the Promotion, you must:
   
   1. collect the right amount of tokens in the application,
   2. unlock the selected case/lootbobox,
      
      1. you can unlock the box/lootbox for free, for tokens, for gems, for viewing an ad, for completing a survey or for doing an activity in the Tubbly app,
   3. open the box/lootbox and see what product, discount, tokens or gems have been assigned to the account,
   4. place an order for a given product (if a discount or product has been granted).
3. Tubbly may require additional confirmation of address data from the Participant or to document the possibility of receiving the shipment, especially when the prize value exceeds PLN 500.
4. Tubbly may make the issuance of the prize dependent on the completion by the Participant of additional tax formalities (e.g. signing the protocol for issuing the prize together with data for tax settlements).
5. Shipping costs outside the territory of Poland may be passed on to the Participant if this is clearly stated in the offer of the Promotion or in a separate communication to the Participant.

4. Types of boxes and rules for unlocking them

1. We provide three types of boxes:
   
   1. Brown — contains up to 500 tokens, 5 gems, products and discounts from the rewards catalog and beyond the rewards catalog,
   2. Silver — contains up to 2000 tokens, 20 gems, products and discounts from the rewards catalog and beyond the rewards catalog,
   3. Golden — contains up to 5,000 tokens, 50 gems, products and discounts from the rewards catalog and beyond the rewards catalog.
2. You can open boxes exclusively in the Tubbly app, once a day for each type of box.
3. Prizes, including products awarded as part of the Promotion, are not exchangeable for cash equivalent, other prizes or any other benefit, unless expressly provided otherwise in these Terms and Conditions.
4. In the event that a given Product runs out, Tubbly reserves the right to offer the Participant another product of similar value and character, of which the Participant will be informed by email or otherwise agreed upon.
5. The prizes (products) will be sent to the Participants to the indicated address in Poland within 30 working days from the date of confirmation by Tubbly of the shipping data. Tubbly shall not be liable for any failure to deliver or delay in the delivery of the prize resulting from the Participant's provision of incorrect or incomplete address details.

5. Publication of the image

• Do you agree that Tubbly can — if necessary and with your additional, separate consent — ask you to be able to publish your name, surname or image (e.g. in the form of an interview) on the Tubbly website or on Tubbly social media.
• The execution time of the prize exceeding the value of 500 PLN may be longer than usual (we will inform the User about this by e-mail).

6. Exclusion from the Promotion

1. Tubbly may exclude from the Promotion or refuse to send/transfer a prize if:
   
   1. you violate the provisions of these Terms and Conditions,
   2. you do not meet the conditions of participation (e.g. no active account or no collected 2 spots on Tubbly),
   3. Tubbly may exclude Entrants from the Promotion who engage in manipulation, attempt to fraudulently increase the chance of winning a prize (e.g., by using software that automates participation in the Promotion, or create multiple accounts through new email addresses or temporary emails) or otherwise violate the rules set forth in the Terms and Conditions or the good of Tubbly.

7. Complaints

• in another way that allows us to collect them (e.g. via the contact form on the website www.tubbly.io).

2. Complaints must be submitted within 30 days from the date of the incident to which they relate.
3. In the complaint we ask you to indicate your name, surname, address, date and description of the event.
4. We will deal with your complaint within 14 days from the date of receipt of the complaint and we will notify you of our decision in the same manner in which we received the complaint (or as otherwise agreed with you).
5. In the event of a reasonable suspicion of an error or irregularity in the award process (e.g., errors in the token generation system, problem with the allocation of points), Tubbly reserves the right to suspend the redemption of the prize until the matter is clarified.

8. Protection of personal data

1. We process your personal data in order to carry out the Promotion and fulfill tax and accounting obligations.
2. The administrator of personal data is:

3. We process your data in accordance with the provisions of the GDPR and the Personal Data Protection Act of 10 May 2018.
4. Detailed rules for the processing of personal data and information about your rights can be found in our Privacy Policy (https://www.tubbly.io/polityka-prywatnosci-tubbly-app).
5. In case of winning a prize worth more than PLN 500, Tubbly may require additional personal data (e.g. PESEL number for tax purposes, confirmation of residence address) in order to comply with the obligations arising from the law.
6. If the Participant refuses to provide the necessary personal information, Tubbly may refuse to issue a prize or otherwise restrict the ability to participate in the Promotion if this is necessary from the point of view of the law.

9. Amendments to the Terms and Conditions

1. The Terms and Conditions are available on the website www.tubbly.io.
2. We have the right to make changes to the Terms and Conditions to the extent permitted by law.
3. We will inform you in advance about possible changes by e-mail or on the website www.tubbly.io
4. The changes do not violate the rights acquired by the Participants and do not worsen the conditions of the Promotion.
5. If you do not accept the changes, you have the right to cancel your participation in the Promotion without any consequences.

10. Final provisions

1. In matters not regulated in these Terms and Conditions, the Tubbly Regulations apply (https://www.tubbly.io/warunki-uzytkowania-tubbly) and the provisions of Polish law.
2. Participation in the Promotion is tantamount to acceptance of these Terms and Conditions.
3. Tubbly is not liable for damages resulting from improper use of the Application, including the consequences of the Participant's sharing of login details with third parties.
4. Tubbly is not responsible for technical problems or limitations related to the telecommunications infrastructure used by the Participant (including network failures, internet outages) that prevent or hinder participation in the Promotion.
5. In the case of in-kind rewards, Tubbly shall not be liable for any hidden defects in the goods or for their non-conformity with the description to the extent beyond the warranty or warranty under generally applicable law.
6. Tubbly shall not be liable for delays or non-performance of obligations arising from the Promotion if this is caused by events of a force majeure nature, i.e. external events, unforeseeable and unforeseeable (e.g. natural disasters, wars, general strikes, failures of IT systems independent of Tubbly).
7. If the Force Majeure Event continues for more than 30 days, Tubbly may decide to terminate the Promotion and inform Participants thereof in the manner indicated in the Terms and Conditions.
